The purpose of the present General Conditions is to define the terms and conditions for the provision of the services of the site www.afgholding-sa.com, hereinafter referred to as “the Service” and the conditions of use of the Service by the User.

Definitions
User: means any person who uses the Site or any of the services offered on the Site.
User Content: refers to the data transmitted by the User in the various sections of the Site.
Member: refers to a user identified on the site.
Identifier: The term “User ID” refers to the information required to identify a user on the Site in order to access the areas reserved for members.
Password: The “Password” is confidential information, which the User must keep secret, allowing him/her, used in conjunction with his/her User ID, to prove his/her identity.
Access to the service
The Service is accessible free of charge to any User with Internet access. All costs related to access to the Service, whether hardware, software or Internet access costs, are the sole responsibility of the User. The User is solely responsible for the proper functioning of his/her computer equipment and Internet access.
Certain sections of the site are reserved for Members after identification using their User ID and Password.
AFG Holding reserves the right to refuse access to the Service, unilaterally and without prior notice, to any User who does not comply with these terms of use.
AFG Holding uses all reasonable means at its disposal to ensure quality access to the Service but is under no obligation to do so.
AFG Holding cannot be held responsible for any network or server malfunction or any other event beyond its reasonable control that prevents or impairs access to the Service.
AFG Holding reserves the right to interrupt, temporarily suspend or modify access to all or part of the Service without prior notice or notification, in order to perform maintenance or for any other reason, without the interruption giving rise to any obligation or compensation.
Personal data
AFG Holding respects the legal provisions on personal data, in particular the Ivorian law n° 2013-450 of June 19, 2013, on the protection of personal data.
The Users are likely to communicate to AFG Holding personal data concerning them by filling in the forms or questionnaires on the present site.
This data will be used for the following purposes: processing information requests, establishing statistics, for commercial prospecting purposes, and for the execution of legal, regulatory and administrative provisions in force.
In accordance with the applicable regulations, any canvassing by automatic calling machine, e-mail, SMS, MMS or fax, as well as any transfer or rental of data for canvassing purposes using these means, will only be carried out with the prior consent of the User to receive canvassing via this channel and/or to the transfer of his/her data. The personal data collected is intended exclusively for the use of AFG Holding, its subsidiaries, its foundations and its service providers, if any. It will not be made available to third parties under any circumstances. However, AFG Holding reserves the right to transmit the personal data of any User in order to comply with its legal obligations, and in particular if it is forced to do so by judicial requisition.
AFG Holding may transfer the personal data collected to entities of AFG Group as well as to its service providers established outside the Ivory Coast. These data transfers take place under conditions and guarantees that ensure the protection of Users’ personal data.
AFG Holding implements all technical and organizational measures necessary to ensure the security and confidentiality of personal data collected and processed, and in particular to prevent them from being distorted, damaged or communicated to unauthorized third parties, by ensuring a level of security appropriate to the risks associated with the processing and the nature of the data to be protected. All Users have the right to access their personal data, to rectify it and to object to it in accordance with the applicable regulations.

Duration and termination
This contract is concluded for an indefinite period of time from the time the User uses the Service.
Applicable law and jurisdiction
The rules of law applicable to the contents and data transmissions on and around the site are determined by Ivorian law.
In case of dispute, which could not be amicably agreed, only the Ivorian courts of the jurisdiction of the Court of Appeal of Abidjan are competent.
